Personal Injury

Thinking ICBC represents you when you’re injured in an accident is not true. ICBC represents them.

Injuries cause by an accident that is not your fault or only partially your fault, we know that you should be properly compensated for your injuries and damages by the person that hit you. (this person is known as the defendant)

We are fortunate that insurance is mandatory in BC and most likely ICBC is the insurance company defending the claim against you.
It’s not you that ICBC represent, but the defendant. You may have heard the term “third party liability insurance”. You are the third party. That’s why personal injury lawyers always tell you to call them first. So giving a statement and authorizations to ICBC instead of through a personal injury lawyer is not in your best interests, this gives ICBC the opportunity to get information they may not be entitled to under the law and use it against you.

ICBC will often speak about their own policies as if those policies are law. They’re not. Speaking to a personal injury lawyer about your rights and obligations is.

We are happy to assist you with finding the best possible representation available to discuss your case with a free initial consultation. It’s important to know the law including

  • ICBC’s obligations to you
  • your obligations to ICBC
  • what damages you may be entitled to under Part 7 benefits (no fault) and tort. This means what you can get now vs what you can get on settlement or judgment.
  • damages you can claim including non-pecuniary damages (pain, suffering and interference with your life)
  • past wage loss
  • future capacity loss
  • loss of housekeeping, maintenane
  • future care and special damages

Finding the right lawyer to assist you (usually take your case on a contingency fee basis which allows you to be represented and not pay fees until settlement or judgment) or to pay the disbursements in the interim (litigation costs) so you aren’t financially burdened while trying to recover from an accident.

If you have had a personal injury like car accident or slip or fall, please contact us, we are committed to assisting you find the best cost effective, professional & caring representation.
